Terms of Service

1. Acceptance of Terms

By accessing or using B&B Discs (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

2. Marketplace (P2P) Transactions

B&B Discs provides a marketplace for users to buy and sell used disc golf discs. In these transactions, B&B Discs acts as a facilitator and is not a party to the contract of sale between buyer and seller.

2.1 Local Pickup

Buyers and sellers may agree to complete delivery of a purchased item via an in-person handoff (“local pickup”). All local pickup purchases must still be paid for in full through the Platform before the exchange; arranging or accepting payment outside the Platform (including cash at pickup) violates Section 6. B&B Discs is not present at, does not supervise, and does not guarantee the safety of any in-person exchange, and is not liable for any loss, damage, or injury arising from an in-person meetup. We strongly recommend meeting in a public place — see our local pickup safety guidelines.

3. Vendor Sales (Retail)

For items sold directly by B&B Discs or authorized third-party vendors, the following terms apply:

• Inventory: We strive for 100% accuracy in our live inventory, but reserve the right to cancel orders due to stock errors.
• Returns: New, unused discs may be returned within 30 days. Used marketplace items are final sale unless they do not match the listing description.

4. Payments & Stripe

All payments on B&B Discs are processed via Stripe. By using our payment features, you agree to Stripe's Services Agreement. Sellers must connect a valid Stripe Connect account to receive payouts. Seller earnings are deposited to the seller's bank account on a rolling schedule approximately 7 days after each sale; this holding period covers the typical delivery window and supports the dispute process described in Section 5.

5. Dispute Resolution

If a marketplace transaction does not go as planned, users may open a dispute via the Platform. B&B Discs reserves the right to mediate disputes and make final determinations regarding refunds or payouts based on evidence provided (photos, tracking info, etc.).

5.1 Non-Delivery Monitoring

If a marketplace order has not shown a delivery confirmation from the carrier within 14 days of purchase, B&B Discs may automatically open a dispute on the buyer's behalf and notify both parties. This automatic flag is a request for review — it is not a refund and does not guarantee any particular outcome. The seller will be given an opportunity to respond with evidence (such as proof of drop-off or tracking history) before B&B Discs makes a final determination under this Section 5.

5.2 Payout Reversals

If B&B Discs resolves a dispute in the buyer's favor after a seller payout has already been made, B&B Discs may reverse or deduct the corresponding portion of that payout from the seller's connected Stripe account, including via Stripe's transfer reversal mechanism. For orders containing multiple items, only the payout amount attributable to the disputed item is refunded and reversed — other items in the same order are not affected. If a payout reversal cannot be completed in full (for example, due to insufficient available balance in the seller's connected account), the seller remains liable to B&B Discs for the shortfall, which may be deducted from future payouts or otherwise collected, and may result in account suspension pending resolution.

6. User Conduct

You may not use B&B Discs for any illegal activity, harassment, or to circumvent our platform fees by arranging off-platform transactions. Violation of these terms may lead to account suspension or permanent banning.

7. Limitation of Liability

B&B Discs is not liable for the quality of discs sold in the P2P marketplace or for any damage incurred during shipping by third-party carriers. Our total liability is limited to the platform fee collected on the specific transaction in question.

8. Governing Law & Venue

These Terms and any dispute arising out of or related to them or the Platform shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles. Any legal action or proceeding arising under these Terms that is not resolved through the dispute process described in Section 5 shall be brought exclusively in the state or federal courts located in the State of Texas, and each party irrevocably consents to the personal jurisdiction and venue of those courts.

9. Copyright & DMCA

B&B Discs respects intellectual property rights and expects users to do the same. If you believe that content on the Platform infringes your copyright, please send a written notice containing all of the following to our designated copyright agent:

• A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
• Identification of the copyrighted work you claim has been infringed.
• Identification of the material you claim is infringing, with enough detail for us to locate it on the Platform (e.g., a URL).
• Your contact information: name, mailing address, telephone number, and email address.
• A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

Counter-Notice: If you believe your content was removed in error, you may submit a counter-notification to the agent above containing: your physical or electronic signature; identification of the removed material and its prior location; a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; your name, address, and telephone number; and your consent to the jurisdiction of the federal district court for your judicial district (or, if outside the US, any judicial district in which B&B Discs may be found).

Repeat Infringers: B&B Discs will terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of intellectual property rights.
